This Payment Agreement (“Agreement”) is made and entered into by and between the student (“Student”) and AVIET LTD – Maintenance Training Organization (“AVIET”). By signing this Agreement, the Student acknowledges and agrees to the terms and conditions outlined below.
1. Payment Terms
1.1 The total course fee shall be paid according to one of the following payment plans, as agreed between the Student and AVIET:
Full Payment:
– 100% of the course fee payable before the course start date.
x2 Installments:
– 50% due before the course start date.
– 50% due before the practical training commencement.
x3 Installments:
– 50% due before the course start date.
– 30% due upon completion of theoretical training.
– 20% due three (3) days before the practical training commencement.
1.2 The Student agrees to make all payments in accordance with the selected payment plan.
2. Payment Obligations & Guarantee
2.1 The Student is required to ensure timely payments as per the agreed-upon schedule.
2.2 In the event the Student anticipates a delay or is unable to make a payment on time, the Student must notify AVIET in writing at least three (3) business days before the due date. This notice must include the reason for the delay and a proposed alternative payment arrangement.
2.3 AVIET reserves the right to approve or reject any alternative payment arrangement at its sole discretion.
3. Consequences of Late or Non-Payment
3.1 If the Student fails to make payments according to the agreed schedule and has not received prior approval for an alternative arrangement, AVIET reserves the right to take any or all of the following actions:
Suspension of Participation: The Student may be suspended from attending training sessions until all outstanding payments are made.
Denial of Certification: AVIET may withhold the issuance of the course completion certificate until all outstanding payments, including applicable late fees, have been settled.
Debt Collection: AVIET may disclose the Student’s relevant contact and account details to an authorised debt-collection agency to recover outstanding amounts.
Legal Action: AVIET, or its authorised agent, may commence legal proceedings to recover sums due. The Student is liable for all reasonable recovery costs, including agency fees, legal costs (on a solicitor–client basis where permitted), and court and enforcement fees.
3.2 The Student shall incur an interest charge of 0.1% per day on the overdue amount for each day of delay. A separate invoice will be issued for the delay fees, including the relevant bank details for payment. All payments shall be made at the Student’s own cost and risk.
4. Refund & Withdrawal Policy
4.1 All payments made under this Agreement are non-refundable unless AVIET cancels the course.
4.2 If the Student voluntarily withdraws from the course for any reason, they remain liable for all outstanding payments according to the agreed payment plan.
4.3 In exceptional cases, AVIET may, at its sole discretion, consider a partial refund or credit for future training, provided that the Student submits a formal written request with supporting documentation.
5. Amendments & Legal Binding
5.1 This Agreement constitutes a legally binding contract. Any modifications to this Agreement must be made in writing and signed by both parties.
5.2 The Student agrees that by signing this Agreement, they are legally obligated to complete all payments as per the selected payment plan.
5.3 This Agreement shall be governed by and construed in accordance with the laws of Malta. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of Malta.
