Introduction

Welcome to AVIET LTD (“we”, “us”, “our”), an EASA Part-147 Aircraft Maintenance Training Organization registered in Malta. These Terms and Conditions govern the use of all services, platforms, and systems under the aviet.aero domain (collectively, the “Platform”). This includes but is not limited to:

  • Online theoretical courses via video conferencing or e-Learning platforms.
  • Physical theoretical and practical training courses.
  • Online and physical examination services, including digital examinations.
  • Student enrollment, course tracking, and certification management.
  • Billing, invoicing, and online payments.
  • Management of student documents as required by the European Aviation Safety Administration (EASA) and Civil Aviation Authorities (CAAs).
 

By using the Platform, purchasing, or receiving training services, you agree to these Terms and Conditions. If you do not accept these Terms, please refrain from using our services.

Registration and Account Management

  • Users, students, and customers must provide accurate and complete registration details.
  • By registering and signing registration details you are accepting financial terms and conditions.   
  • Users, students, and customers are responsible for maintaining the confidentiality of their login credentials.
  • AVIET LTD reserves the right to suspend or terminate accounts that provide false or incomplete information.
  • Employees, customers, and students must comply with internal policies when accessing and using the system.
 

Intellectual Property

  • All content on the Platform, including text, graphics, videos, software, and documents, is the intellectual property of AVIET LTD or its licensors.
  • Users may not reproduce, distribute, or create derivative works without prior written consent.
  • AVIET LTD reserves the right to remove any unauthorized content posted by users.
 

Privacy and Data Protection

  • We are fully GDPR-compliant and handle personal data according to our Privacy Policy.
  • Student data, certification records, and enrollment information may be shared with relevant aviation authorities as required by law.
  • We partner with third-party providers for services such as hosting (Hetzner Online GmbH), payment processing (Stripe, Inc.), online course delivery (Zoom Communications, Inc.), and automated document information processing (OpenAI, Inc.). These providers operate under their own data protection policies.
  • Submitted student documents and data may be automatically processed by third parties to improve stored data accuracy and consistency.
  • In case of non-payment, we may share relevant contact and account data with authorized agencies for recovery.
 

Training Services and Execution of Contracts

  • Purchase or receival of training constitutes acceptance of these Terms and execution of a binding contract.
  • AVIET LTD conducts training under EASA Part-147 approval reference MT.147.08 and additional CAA approvals.
  • Training locations, requirements, and prerequisites are specified in course descriptions.
  • Examinations and assessments follow AVIET LTD’s internal policies, EASA, and foreign/local CAA regulations.
 

Cancellation and Refund Policy

  • All payments are initially non-refundable unless deemed an exceptional case by AVIET LTD.
  • If you withdraw from a course for any reason, you remain liable for all outstanding amounts under your selected payment plan.
  • If AVIET LTD cancels a course, you may choose between a rescheduled date or credit. If a course is postponed, a new date will be proposed or a training credit offered.
  • In exceptional cases, AVIET LTD may, at its sole discretion, grant a partial refund or credit upon written request with supporting documentation.
  • The option of a refund will only be available depending on the rightfulness and conditions of the cancellation.
  • Refunds exclude bank or payment processor fees and applicable taxes.
  • A student or customer is not eligible for a refund in case they have payed part of or the full course fee, but they did not attend the practical part of the training due to their own unavailability.
 

Termination by AVIET LTD

  • If a course does not meet the minimum number of participants, AVIET LTD reserves the right to cancel and issue training credits.
  • If a training session cannot proceed due to aircraft unavailability or other unforeseen circumstances, a new date will be proposed, or credit will be issued.
 

Fees, Payment, and Certification

  • In case of a signed Payment Agreement between AVIET LTD and the customer, the Payment Agreement terms and outlined payment plan shall be respected.
  • Payments must follow the selected plan. If you anticipate delay, notify AVIET LTD in writing at least three (3) business days before the due date with reason and a proposed alternative. Approval is at AVIET LTD’s sole discretion.
  • Training participation may be suspended until overdue amounts are paid.
  • AVIET LTD may withhold certificates until all outstanding sums (including late fees) are settled.
  • Invoices must be settled within the specified time frame to avoid penalties.
  • Training certificates are issued only after enrollment, full payment, and successful completion of the course with examinations.
  • Where amounts remain unpaid, AVIET LTD may disclose relevant contact and account details to an authorized debt-collection agency and/or commence legal proceedings. You are liable for reasonable recovery costs, including agency fees, legal costs (on a solicitor–client basis where permitted), and court/enforcement fees.
  • Customers shall incur an interest charge of 0.1% per day on the overdue amount for each day of delay. A separate invoice will be issued for the delay fees, including the relevant bank details for payment. All payments shall be made at the customer’s own cost and risk.
 

Online Training and Examinations

  • Online training is available only for registered users.
  • Users must ensure a stable internet connection and meet technical requirements.
  • Certification is issued after successful course completion, subject to verification.
  • Users are responsible for compliance with examination rules, including identity verification.
  • Users are responsible for keeping track of their theoretical absence time.
  • AVIET LTD reserves the right to deny further training or certification to users due to exceeded maximum absences as per EASA/CAA regulations.
  • Extra hours due to exceeded absences are charged additionally to the standard course fees.
 

Liability and Indemnity

  • AVIET LTD is not responsible for travel, accommodation, or incidental costs incurred by students.
  • Users are responsible for ensuring they meet the health and safety requirements for physical training sessions.
  • AVIET LTD is not liable for damages resulting from training performance, except in cases of gross negligence or intent.
  • Users indemnify AVIET LTD against claims related to misuse of the Platform or non-compliance with regulations.
 

Agent Disclaimer

AVIET LTD collaborates with independent regional agents to support international students by sharing information about our training programs and promotions. These agents act solely as facilitators and are not authorized to change, interpret, or override AVIET LTD’s official terms, policies, agreements, or decisions in any way.

Any separate promises or agreements made between you and an agent are not binding on AVIET LTD. Only communication issued directly by AVIET LTD is considered official.

Modifications to Terms and Conditions

  • AVIET LTD reserves the right to modify these Terms at any time.
  • Continued use of the Platform after changes constitute acceptance of the revised Terms.
  • Users will be notified of significant changes via email or Platform announcements.
 

Governing Law and Dispute Resolution

  • These Terms and Conditions are governed by the laws of Malta.
  • Disputes arising from these Terms shall be subject to the exclusive jurisdiction of Maltese courts.
